1. Acceptance of Terms

By visiting, registering for, or using any feature of KUCCPSS ("the Platform", "we", "us"), you confirm that you have read, understood, and agree to these Terms and Conditions and our Privacy Policy. If you do not agree, you must stop using the Platform immediately.

2. Description of Services

KUCCPSS provides tools to help Kenyan KCSE students:

• Calculate cluster points using the official KUCCPS formula
• Discover university, KMTC, TVET, and TTC courses they may qualify for
• Access career profiles, guidance articles, and placement information
• Receive AI-assisted career recommendations (premium feature)

The Platform is intended as a guidance tool only and does not guarantee admission to any institution. Actual placement decisions are made solely by KUCCPS and the relevant institutions.

3. Eligibility

You may use the Platform if you:

• Are at least 13 years old (users under 18 should use the Platform with parental/guardian awareness)
• Provide accurate information during registration
• Have not been previously suspended or banned from the Platform

4. User Accounts

When you register, you are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Accuracy of Information

While we strive to keep course information, cutoff points, and cluster data up to date, KUCCPSS does not warrant the completeness, accuracy, or timeliness of any information on the Platform. Cutoff points change every academic year. Always verify important details directly with KUCCPS or the relevant institution before making any decisions.

6. Payments & Refunds

Some features of the Platform (such as unlocking full career results) require payment via M-Pesa. By making a payment, you agree that:

• Fees are stated in Kenyan Shillings (KES) and are inclusive of applicable taxes
• Payments are processed securely via Safaricom Daraja M-Pesa
• Refunds are issued only where a payment was processed but the feature could not be delivered due to a technical error on our side; change of mind does not qualify
• To request a refund, contact us within 7 days of the transaction

7. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, templates, and code — is owned by KUCCPSS or its licensors and is protected by Kenyan and international copyright law. You may not reproduce, distribute, or create derivative works without our express written permission.

The KUCCPS cluster points formula is based on the official KUCCPS algorithm and is used here purely for educational purposes.

8. Privacy

We collect only the information necessary to provide our services (name, email address, KCSE grade data entered by you). We do not sell your personal data to third parties. Grade data entered into the calculator is stored only to provide your results and improve the service. For details, please contact us at the address below.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform or its servers
• Scrape, copy, or redistribute Platform content in bulk without permission
• Submit false or misleading information
• Use automated bots, scripts, or crawlers without prior written consent
• Harass, abuse, or harm other users

10. Limitation of Liability

To the fullest extent permitted by Kenyan law, KUCCPSS and its team shall not be liable for any direct, indirect, incidental, or consequential loss arising from:

• Reliance on course or cutoff information displayed on the Platform
• Failure to gain admission to any institution
• Interruption, errors, or unavailability of the Platform

The Platform is provided "as is" without warranties of any kind.

11. Changes to Terms

We may revise these Terms at any time. The "Last updated" date at the top will reflect the most recent version. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms. We will notify registered users of material changes via email where possible.
